1. Service Provision and Access   
1.1 	"Service" shall mean the access to Internet, which comprises a group of Internet worked computers, and shall include any features that may be added thereto by Telekom Brunei Berhad (TelBru) from time to time. The said service is provided by TelBru under the name of BruNet. 
1.2 	The minimum period of subscription is one calendar month. 
1.3 	A user identification (ID) and a password will be assigned to the Customer, who shall provide his own means (for example, telephone service and modem) to establish physical connection to BruNet. 

2. Charges, Fees and Rental   
2.1 	The charges, fees and rentals for the Service and equipment, as the case may be, shall be at such rates prescribed by TelBru from time to time and payable in advance or at such other time as prescribed by TelBru. The said charges, fees and rentals shall be payable commencing from the date the Service is made available to the Customer. 
2.2 	The Customer shall be liable for and shall promptly pay on demand all charges, fees, rentals, costs and other amounts whatsoever as stated in the bill from TelBru. 
2.3 	Should any charges, fees or rentals remain unpaid after becoming- due, TelBru may terminate the Service without prior notice and without prejudice to any antecedent rights or remedies. 

3. Termination   
3.1 	The Customer may terminate the Service by giving to TelBru at least one month prior notice in writing or paying a sum in the amount equivalent to one month subscription fee for his Usage Plan in lieu thereof. 
3.2 	The date of notice of termination as stated in clause 3.1 shall be the date of receipt thereof by TelBru. 
3.3 	TelBru may term-terminate the Service at any time without prior notice and is not bound to give any reason whatsoever. 

4. Customer's Liability on Termination   
4.1 	In the event of termination of the Service during the n-minimum period of subscription, the Customer shall be liable to pay TelBru all charges, fees and rentals for the whole of the minimum period of subscription. 
4.2 	In the event of tern-termination of the Service after the minimum period of subscription, the Customer shall be liable for charges, fees and rentals due up to and including the date of termination. 

5. Customer's Responsibilities   
5.1 	The Customer shall protect the secrecy of the user identification and password assigned to him at all times and shall ensure that, they are not revealed or disclosed in any manner whatsoever to any person or persons whosoever. The Customer shall be fully responsible for and shall bear all charges, losses or damages arising from any use of his user identification and password howsoever they may arise. 
5.2 	The Customer shall at all times use only his own ID and password for accessing the Service. The Customer should change his password from time to time to enhance its security. 
5.3 	The Customer shall not: 
 	5.3.1 	Use the service:
 	a)	for any unlawful purposes such as, but not limited to, vice, gambling or other criminal- purposes whatsoever nor for sending or receiving any message which is offensive on moral, religious, communal or political grounds, or is abusive or of an indecent, obscene or menacing character; or 
b)	for persistently sending messages without reasonable cause or for causing any threat, harassment, annoyance, inconvenience or needless anxiety to any person whosoever; 

5.3.2 	through the use of the user identification or password infringe any copyright or other intellectual property rights to the information or resources available nor shall the Customer retain such information or resources for re-use in any computer system or otherwise; 
5.3.3 	attempt to gain access to any computer system connected to Internet without authorization by the owner of the computer system. Any unintentional access shall be tern-terminated immediately and be reported to the appropriate owner of the device or equipment or to TelBru, 
5.3.4 	use the Service to access information or resources which are private to individuals and organizations unless permission to do so has been granted by the owners or holders of the rights to such resources and information; and 
5.3.5 	provide networking services using BruNet network to other parties without a written agreement with TelBru. 

5.4 	The Customer shall, when accessing any other network through the Service, comply with the rules appropriate for such other network. 
5.5 	The Customer shall be solely responsible for the data retrieved, stored or transmitted- through the Service. 
5.6 	The Customer shall be solely responsible for managing the use of the storage capacity such that it is within the capacity allocated to him or as may be stipulated by TelBru from time to time 

6. TelBru's Rights   
6.1 	TelBru reserves the right to manage and control the access to the Service, including access to data stored in or transmitted through the BruNet system, in any manner deemed appropriate by TelBru. 
6.2 	TelBru does not: 
 	6.2.1 	provide any support for any publicly accessible software distributed through BruNet network. TelBru also does not guarantee that the software is free from any bug or virus. 
6.2.2 	guarantee the end-to-end transmission- throughput of any connection through BruNet network. 

6.3 	TelBru shall not be responsible for any consequence of using BruNet either directly or indirectly. 
6.4 	TelBru will do its best to safeguard information passing through BruNet network from any unauthorized access. However, TelBru does not guarantee the confidentiality of information. Customers shall take appropriate action to safeguard their own information. 

7. Changes in Usage Plan   
7.1 	In the event that the Customer desires to change his Usage Plan, he shall notify TelBru of the same in writing not less than fourteen (14) days in advance. The effective date of the change shall be the first day of the month subsequent to the expiry of the said fourteen (14) days' notice or such other dates as TelBru may decide from time to time. 

8. Use of Software   
8.1 	The Customer is free to use any software ("the Software") supplied by any software vendor for accessing the Service. The use of the Software shall be subject to the terms and conditions stated herein. 
8.2 	TelBru makes no warranty and hereby disclaims all liabilities whatsoever in respect of or arising out of the Software provided to the Customer. The Customer shall have no remedy against TelBru for defects in the Software. TelBru shall not be liable to the Customer for any damages whatsoever, including any loss of profits, lost savings, or other incidental or consequential damages arising out of the Customer's use or inability to use the Software, even, if TelBru or any of its authorized representative has been advised of the possibility of such damages, or for any claim by any other party whomsoever. 
8.3 	The Customer shall satisfy himself as to the suitability of the Software for his needs. In addition, he shall also be responsible for ensuring the compatibility of the Software for use in any equipment which may be used or owned by him. 
8.4 	In the event that changes are introduced to TelBru's network, TelBru shall not be responsible to ensure that the Software will continue to be compatible with TelBru's network and the Customer shall have no claim whatsoever against TelBru arising therefrom. 
8.5 	The Customer shall strictly comply with and ensure compliance by his servants and agents with all instructions or notices in whatever form and through whatever means given by TelBru from time to time regarding the use of the Software. 

9. Compliance with Laws   
9.1 	The Customer shall strictly comply with all applicable laws of Brunei Darussalam relating to the Service. 

10. Students and Minors   
10.1 	Any Customer below 25 years old who is not in any employment and who is a full-time student can qualify to be a student member. The student status shall be certified by the school headmaster or the head of department. TelBru reserves the right to request recertification of the student status. 
10.2 	Each account for student members shall be used only for the approved member and is non-transferable. The account shall not be used for organizational purposes. 
10.3 	Each account for student members has a validity of one year and can be extended 3 months before expiry date for another one year upon the production of a new certification of the student status from the school headmaster or the head of department. 
10.4 	If the Customer is under the age of 18, his Guardian, whose name and signature appear in the application fore shall be responsible for the due payment of all charges, fees and rentals. Such liability shall not be terminated or affected by the death of the Guardian. The Guardian shall also ensure that the Customer complies with the terms and conditions stated herein.
